Apuntes introductorios a la metodología del conocimiento jurídico en el Civil Law
Abstract
In the Germanic-Roman or continental European legal culture, orientation towards the knowledge of law has been paradigmatic, especially with regard to the theorizing of its phenomenology from a scientific perspective built on the logic of positive natural and sociological sciences. Nevertheless, this paradigm has undergone a number of considerable changes, the coming of post-modernity, leading to the return of the legal phenomenology to humanistic studies, in their search for the recovery of practical reason, and the realization of a legal method which is less influenced by science, and of more methodical plurality. The study gives an account, through a condensed descriptive inventory, of the main methodological landmarks of this point in the history of legal knowledge of Civil Law.
