La extinción de dominio en la legislación mexicana: su justificación jurídico-valorativa

Abstract

This article discusses the recent Mexican process to establish civil forfeiture as a legal i nstrument to fight organized crime. The author concludes that this figure corresponds to an in personam right of compensation, which corresponds to society and upon which the state acts as plaintiff. The paper answers objections that have been put forth ag ainst this legal institution in Mexico.
