Problemas del tratamiento legal y terapéutico de las transgresiones juveniles de la ley en Colombia

Abstract
The new law of infancy and adolescence in Colombia has both positive and negative aspects,
because apart from the correct emphasis it makes on the subject of the reestablishment of the rights
of these age groups – which have been violated to an alarming extent - it has become necessary
to re-think the concept we have about the responsibility and the methods of legal and therapeutic
intervention of those adolescents who have broken the penal law in our country. In practice, it can
be seen that the approaches founded on Law 1098, are based on a concept of victimization and
assistentialism which leads to the diminishment of the subjective responsibility of these individuals
in relation to the criminal acts for which they are responsible, instead of dvocating the assumption of
responsibility.
